32 former women air force officers get historic victory from supreme court, will get full pension

On 17 February 2020, the Supreme Court gave a historic decision in favor of women officers of the army. The court had said that all women officers serving in the army would get permanent commission. That is, she will be able to work till retirement. Along with this, women officers will also be given command or leadership positions on the basis of their merit.

The decision of the Supreme Court had cleared the way to get permanent commission for all 1653 women officers working in different departments of the army at that time. In that decision, the Supreme Court also extended benefits to those women who were in service after the decision of the Delhi High Court on March 12, 2010. The Supreme Court had said that in 2010 itself the decision had come in favor of women officers. But due to the reluctant attitude of the government, it took more than 9 years to be implemented.

12 Years of Struggle Pays Off
After High Court’s decision in 2010, women officers of Short Service Commission continued to serve and finally they were given permanent commission on the basis of completion of 14 years in service got the benefit of But the women officers who had already retired before the High Court’s decision had to wait for 12 years to get their rights. In the 90s, these women, appointed for short service commission of 5 years, got extension of service twice. In this way he served for 15 years, but was retired without permanent commission.

It was not practical to take back these women who retired between 2006 and 2009. Due to being away from service for a long time and due to old age, he could not be taken back in the army. But a bench headed by Chief Justice DY Chandrachud also declared him entitled to the pension that officers get after 20 years of service.
