Hearing in SC on petition for abortion of 29 weeks pregnancy, AIIMS experts said- “abortion is not appropriate”

A hearing was held on Monday in the Supreme Court on the petition of a girl to abort her 29-week pregnancy. Chief Justice DY Chandrachud asked ASG Aishwarya Bhati to talk to the victim and give her advice. The court will now hear the matter on February 2.

According to the report of AIIMS experts, in this condition of pregnancy, abortion would not be appropriate for the health of both. Also, there are more chances of survival of the child. Justice JB Pardiwala asked whether the victim teenager was aware of the report. On this, the family members of the petitioner and the victim girl said that the girl is still giving the exam. Now till 28 January. Therefore, now the court has fixed the date of hearing of this case on February 2, Thursday.

Earlier, in the case of a 20-year-old unmarried B.Tech student, the Supreme Court had given instructions to constitute a team of AIIMS doctors. The Supreme Court had asked whether abortion can be done safely after 29 weeks. Regarding the matter, the Supreme Court ordered the AIIMS director to form a team of doctors on January 20 and ordered the investigation and submit the report after medical examination of the woman. In September last year, the Supreme Court gave a major verdict in the abortion case. The court had said that whether a woman is married or unmarried, everyone has the right to abortion. After the order, all women were allowed to have abortions for 24 weeks.

Under the Medical Termination of Pregnancy (MTP) Act, the upper time limit for abortion was 24 weeks for a special category of married women, including rape victims and other vulnerable women such as differently-abled and minors, while the same time limit for unmarried women was 20 weeks. The court had ordered to eliminate this difference.
